These Terms of Service ("Terms") govern your access to and use of Lumio Personal Finance ("the App"), a desktop software application provided by Lumio App LLC, a Virginia limited liability company ("we", "us", "our"). By installing, activating, or using the App, you agree to be bound by these Terms.
Please read these Terms carefully. They contain important information about your rights and obligations, including limitations of liability.
"Lumio App LLC" refers to the Virginia limited liability company operating Lumio Personal Finance.
"You" refers to the individual installing or using the App.
"App" means the Lumio Personal Finance desktop software application and all updates.
"License Key" means the unique code provided upon purchase that activates the App.
"Trial Period" means the 14-day period beginning on the date you first launch the App.
By clicking "I agree" at first launch, installing the App, or using it in any way, you accept these Terms and our Privacy Policy. You must be at least 18 years old to use the App.
Subject to these Terms and payment of the applicable fee (or during the Trial Period), we grant you a personal, non-exclusive, non-transferable license to install and use one copy of the App on one device you own or control, for personal non-commercial financial tracking.
Personal non-commercial use includes managing your own finances even if you are self-employed or operate a sole proprietorship. It does not extend to using the App to manage finances on behalf of third parties, providing bookkeeping or financial advisory services to others, or any use that constitutes operating a business with the App as part of the service offering.
The App and all intellectual property remain the exclusive property of Lumio App LLC. These Terms grant you a limited use license only.
The App includes a 14-day free trial from first launch with access to all features. At expiration, a valid License Key is required to continue. Your data is preserved through and after the trial period. The trial is available once per device. Clearing application data to reset the trial is a violation of these Terms.
License Keys are sold through lumioapp.io, processed by Stripe, Inc. Purchase prices are listed on our website and subject to change. Your License Key will be delivered to the email address provided at purchase. You are responsible for keeping that email address accessible.
We offer a 30-day money-back guarantee from your purchase date. Contact info@lumioapp.io with your order information to request a refund. Eligible refunds are processed within 5 to 10 business days of approval, and may take an additional 1 to 3 business days to appear on your statement depending on your payment method.
Refund requests within the 30-day window are approved without conditions or explanation required. After 30 days, refunds are at our discretion and generally limited to cases of material defect or unmet obligations on our part.
Each License Key activates the App on one device. If you replace your device, contact info@lumioapp.io for a transfer. Standard transfer requests are processed within 5 business days. You are responsible for keeping your License Key secure and must not share it.
You retain full ownership of all data you enter into the App. You are solely responsible for maintaining backups. We strongly recommend regular use of the Backup & Restore feature. We are not responsible for data loss resulting from device failure, accidental deletion, software errors, or failure to maintain backups. We have no access to your data under any circumstances.
We may release updates from time to time. You are not required to install them but we recommend doing so. If a material update significantly reduces core functionality and you do not accept it, you may request a refund within 30 days of the change regardless of your original purchase date.
Existing License Key holders will continue receiving the desktop App without any subscription requirement. If we release a future cloud-based or subscription version of Lumio, that version will be a separate product with its own terms. Your one-time purchase grants you access to the desktop App you bought, including reasonable updates to that App. We will not retroactively convert your one-time license into a subscription requirement.
We provide support on a best-efforts basis via info@lumioapp.io. We aim to respond within 5 business days. Support is for App installation, functionality, and license management. It is not a substitute for financial advice.
The App is provided "as is" without warranty of any kind. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
Lumio is a financial tracking tool only and not a substitute for professional financial, tax, investment, or legal advice. All projections and calculations are based on data you enter. Verify important financial information with your financial institution.
To the maximum extent permitted by law, Lumio App LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data or financial losses from decisions made using the App.
Our total liability shall not exceed the greater of: (a) the amount you paid for your License Key in the 12 months preceding the claim, or (b) fifty U.S. dollars ($50).
You agree to defend and hold harmless Lumio App LLC from claims arising from your use of the App in violation of these Terms, your content, or your violation of any applicable law.
We may terminate your license immediately if you breach these Terms, attempt to circumvent the trial or license system, or share your License Key. Upon termination you must uninstall the App. Sections 8, 11, 12, 13, and 15 through 21 survive termination.
These Terms are governed by the laws of the Commonwealth of Virginia, United States. Disputes shall be resolved in the courts of Virginia.
We are not liable for failure to perform any obligation under these Terms due to events outside our reasonable control, including but not limited to natural disasters, acts of government, network or hosting provider outages, denial of service attacks, or pandemic-related disruptions. If a force majeure event materially affects your ability to use the App for an extended period, contact us regarding a prorated refund or credit.
By using the App and providing your email address at purchase, you consent to receive communications from us electronically. This includes legal notices, support responses, important account updates, and changes to these Terms. We will send these communications to the email address associated with your License Key. You are responsible for keeping that email address current and accessible.
This consent does not extend to marketing emails, which we do not send without separate opt-in.
If you experience a billing issue or wish to request a refund, please contact us first at info@lumioapp.io. We will work with you to resolve the issue under our refund policy in Section 6.
Initiating a chargeback or payment dispute with your card issuer or bank without first contacting us, or after a refund has been issued, may result in immediate termination of your License Key, deactivation of the App, and a permanent ban from future purchases. We reserve the right to pursue collection of fraudulent chargebacks through Stripe and applicable legal channels.
These Terms and our Privacy Policy constitute the entire agreement between you and Lumio App LLC. If any provision is unenforceable it will be modified to the minimum extent necessary. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our consent.
We may modify these Terms at any time. Material changes take effect 14 days after notice through the App or the Website. Continued use after changes take effect constitutes acceptance. The current version is always available at lumioapp.io/terms and in the App under Settings > About.
